Caregiver (Sitter) Agreement — My Tails
Version 2.0 · In force since 22 July 2026 · Supersedes the May 2026 version · History: mytails.eu/legal/historial
This Agreement governs the relationship between My Tails (Natalia Grishchenko, NIF Z4429651V, Av. Carlota Alessandri 234, 29620 Torremolinos, Málaga, Spain) and the caregiver (hereinafter, the "Sitter") who registers on the mytails.eu platform to offer their services.
Acceptance of this Agreement is mandatory to complete registration as a Sitter. By accepting it, the Sitter declares that they have read, understood and fully accepted its content.
1. Nature of the relationship
The Sitter provides pet care services on their own account and independently, whether as a self-employed professional or as a private individual (see section 3.1 and the Identity Verification Notice, §8).
It is expressly established that:
- The Sitter is not an employee of My Tails
- There is no employment relationship or commercial relationship of dependency between the parties
- My Tails does not direct or supervise the way in which the Sitter performs the services
- My Tails acts solely as an intermediary platform that facilitates contact between the Sitter and owners
2. Independence and non-exclusivity
The Sitter is free to provide similar services through other platforms or by their own means, and My Tails may not impose exclusivity. The Sitter autonomously determines their availability, their rates and the volume of services they wish to accept. My Tails only sets a minimum publication price per type of service and publishes market reference prices for merely informational purposes, without imposing maximum prices or recommending any amount. The relationship between My Tails and the Sitter does not generate any employment relationship within the meaning of the Workers' Statute.
3. Sitter's obligations
3.1 Registration requirements
To register as a Sitter on My Tails, the caregiver must:
- Be over 18 years of age
- Comply with the requirements of the Animal Welfare Law (2023)
- Pass the identity verification (KYC) process carried out by Stripe
My Tails does not require self-employed (autónomo) status to register on the platform, publish a profile or accept bookings. The Sitter is solely responsible for determining whether their activity requires registration in the Special Regime for Self-Employed Workers (RETA) and in the register of business owners, professionals and withholders, as well as for complying with their tax and Social Security obligations.
It is however necessary to have a Spanish tax identification number (NIF or NIE). This requirement does not derive from a commercial decision by My Tails, but from the information-reporting obligation established in Directive (EU) 2021/514 (DAC7), detailed in section 3.2, and from the payment provider's verification obligations. The number is provided during the setup of the Sitter profile; having a NIF or NIE is not equivalent to, and does not oblige, registration as self-employed.
3.2 Tax obligations
The Sitter is solely responsible for complying with the tax and Social Security obligations corresponding to their situation, including where applicable:
- Issuing invoices for the services provided
- Declaring and settling the corresponding VAT
- Declaring their income in IRPF (personal income tax)
- Paying RETA contributions, if registered as self-employed
- Complying with invoicing obligations under the Verifactu system within the legally required deadlines
My Tails does not provide tax advice and does not determine the Sitter's tax situation.
⚠️ DAC7 — annual reporting to the AEAT. In compliance with Directive (EU) 2021/514, My Tails is required to report annually to the State Tax Administration Agency, via form 238, the Sitter's identifying data (name, address, tax identification number, date of birth and IBAN), the total amount received and the number of services provided in each calendar quarter, as well as the fees withheld by the platform.
The "excluded seller" exception provided in Annex V, Section I.B.4 of the Directive applies exclusively to the sale of goods. Animal care services constitute a relevant personal-services activity, for which no minimum threshold is established. Consequently, reporting is made for every Sitter who receives any amount through the platform during the calendar year.
Legal basis for the processing: compliance with a legal obligation (Art. 6.1.c GDPR). The Sitter declares that they are aware of this reporting.
3.2.1 Consequences of not providing the tax identification number
If the Sitter does not provide their tax identification number, My Tails will send two reminders. After 60 calendar days from the first request without receiving the data, My Tails will apply the payment-withholding measure provided in Annex V, Section II, part D of Directive (EU) 2021/514.
This withholding operates on the following terms:
- The amounts already accrued continue to belong to the Sitter. The withholding does not constitute a penalty, sanction or loss of the right to payment: it is a temporary suspension of payment imposed by European tax regulations.
- Payment will be made in the first settlement cycle following the provision of the tax identification number, without the need for a claim by the Sitter and without any deduction on this account.
- Simultaneously, and as a complementary commercial measure, the profile will stop accepting new bookings until the data is provided. The purpose is to prevent the pending amount from continuing to grow and to avoid owners contracting with a caregiver whose continuity on the platform is conditional.
- In accordance with Article 4.1 of Regulation (EU) 2019/1150, this restriction will be communicated to the Sitter on a durable medium (for example, by email or through a message they can retain and consult in their account) with a reasoned statement of its grounds, before it takes effect or at the time it does. Already-confirmed bookings will be provided and paid normally once the data is supplied.
- The Sitter may provide the tax identification number at any time; doing so lifts both measures automatically.
None of these measures responds to a discretionary decision by My Tails: the withholding of payment derives directly from an obligation imposed by European automatic tax-information-exchange regulations, which provide no alternative other than withholding or closing the account.
3.3 Quality of service
The Sitter undertakes to:
- Provide the services with due diligence and professionalism
- Treat animals with respect and in accordance with the Animal Welfare Law
- Immediately inform the owner and My Tails of any incident or health problem of the animal
- Not delegate or subcontract the services to third parties without the express authorisation of the owner
- Keep their availability up to date on the platform
- Respond to booking requests within 24 hours
3.4 Documentation and verification
The Sitter authorises My Tails to:
- Have their identity verified by Stripe during the onboarding process (KYC); My Tails only receives the result of that verification and the account status (see section 3.1 and the Identity Verification Notice)
- Display their identity-verification status on their public profile
- Indicate on their profile, based on the status declared by the Sitter themselves, whether they act as a professional or as a private individual, for the purposes of Article 97 bis of the TRLGDCU. My Tails does not verify this status or require evidence of self-employed registration; the accuracy of the declaration is the Sitter's responsibility
- Request documentation only when strictly necessary to: (i) comply with a legal obligation; or (ii) provide evidence of the administrative licence and civil liability insurance required when the Sitter accepts potentially dangerous-breed dogs. Outside these cases, My Tails will not request additional documentation
4. My Tails' fee
My Tails does not charge the Sitter any fee. The Sitter receives 100% of the price they themselves set. The platform's service fee is paid by the owner, in addition to the caregiver's price, and is shown itemised during the booking process. The payment-processing fee (Stripe) is borne entirely by My Tails.
- Payments are processed through Stripe Connect: the amount corresponding to the Sitter is credited to their connected account at the moment the owner pays
- Transfers to the Sitter's bank account are made in a weekly batch, every Monday, and include bookings completed at least 48 hours in advance and with no open dispute
- If there is an open dispute over a booking, the corresponding payment is withheld until its resolution (see the Cancellation Policy, section 6)
5. Liability in the event of incidents
5.1 Sitter's liability
The Sitter assumes direct liability to the owner for:
- Physical harm caused to the animal during the provision of the service
- Loss or straying of the animal in their custody
- Harm caused by the animal to third parties during the service
- Failure to follow the instructions provided by the owner
5.2 Insurance
My Tails is not an insurance company or insurance intermediary and does not offer any insurance coverage to the Sitter or the owner. My Tails does not hold a policy covering the harm that may occur during the provision of the services contracted through the platform.
The Sitter is strongly advised to hold a valid professional civil liability insurance policy, although this does not constitute a requirement for registration on the platform.
During the booking process, My Tails may offer the owner the voluntary contracting of insurance marketed by a third party; such contracting is optional, is perfected directly with the corresponding insurance company, and My Tails in no case assumes the status of insurer.
5.3 My Tails' exoneration
My Tails assumes no liability for harm caused by the Sitter during the provision of the service, or for its quality or outcome.
6. Animal Welfare Law (2023)
The Sitter declares that they are aware of and comply with Law 7/2023 of 28 March on the protection of the rights and welfare of animals (BOE-A-2023-7936, consolidated text: https://www.boe.es/eli/es/l/2023/03/28/7), as well as the regional animal-welfare regulations applicable in their community. This includes, among other obligations, the prohibition of methods based on physical or psychological punishment, the duty of veterinary care and the maintenance of the minimum care conditions established in that Law.
Breach of this Law is grounds for immediate removal from the platform.
7. Confidentiality
The Sitter undertakes not to disclose or use the personal data of owners and their animals for purposes other than the provision of the service, and to comply with the GDPR at all times.
8. Ranking transparency (Article 5 of Regulation (EU) 2019/1150)
In accordance with Article 5 of Regulation (EU) 2019/1150 on promoting fairness and transparency for business users of online intermediation services, My Tails discloses the main parameters determining the ranking of profiles in search results, ordered from greater to lesser relative importance, and the reasons for that importance:
- Geographical proximity to the address indicated by the owner — the most significant factor, as it determines the material viability of the service.
- Effective availability on the requested dates — an unavailable profile cannot provide the service.
- Average rating received from owners who completed a booking — reflects the verified quality of the service.
- Response rate to requests received — a lack of response frustrates the booking.
- Cancellation rate of confirmed bookings — the caregiver's cancellations frustrate already-closed bookings and directly affect the consumer.
My Tails does not direct or supervise the way in which the Sitter performs the services; this clause does not imply any employment relationship between the parties.
In accordance with Article 5.6 of Regulation (EU) 2019/1150, the above information does not oblige My Tails to disclose its algorithms or any detail whose disclosure would, with reasonable certainty, allow the manipulation of search results to the detriment of consumers.
8.1 Guarantees under Regulation (EU) 2019/1150
Modification of terms (Article 3.2). Any modification of this Agreement will be notified to the Sitter on a durable medium —email or a message they can retain and consult in their account— at least 15 calendar days before it takes effect. The Sitter may terminate the Agreement before the modification takes effect.
Restriction, suspension and termination (Article 4). Restriction or suspension of services will be communicated to the Sitter with a reasoned statement of the grounds before it takes effect or at the time it does.
Termination of the Agreement by My Tails' decision and without cause attributable to the Sitter (for example, ceasing activity in their area or a change to the service model) will be communicated at least 30 calendar days in advance and with written reasons, in accordance with Article 4.2 of Regulation (EU) 2019/1150. This notice period will not apply, and the measure may take effect immediately, where there is a legal obligation, a risk to the safety of persons or animals, or repeated breaches by the Sitter (Article 4.4 of the same Regulation).
Differentiated treatment (Article 7). The "Founding Sitter" programme grants the first hundred caregivers registered in each launch city a permanent identifying badge on their profile and ranking priority in search results during the first three months following the launch in that city.
9. Suspension and removal from the platform
My Tails may suspend or remove the Sitter's profile for:
- Breach of any obligation of this Agreement
- Repeated negative reviews or well-founded complaints
- Repeated cancellations of confirmed bookings
- Fraudulent conduct or conduct contrary to good faith
- Breach of the Animal Welfare Law
10. Appeal against My Tails' decisions (DSA Art. 17)
Regarding any decision to suspend, restrict or remove the Sitter's profile, My Tails will provide an individualised statement of reasons. The Sitter will have 15 calendar days from notification of the decision to submit an internal appeal to My Tails by writing to hello@mytails.eu. My Tails will resolve the appeal with a statement of reasons within a maximum of 15 working days.
11. Modification of the Agreement
My Tails may modify this Agreement by notifying the Sitter at least 15 calendar days in advance by email, in accordance with Article 3.2 of Regulation (EU) 2019/1150 (section 8.1). Continued use of the platform after that period implies acceptance of the changes; the Sitter may terminate the Agreement before that date without any penalty.
12. Applicable law and jurisdiction
This Agreement is governed by Spanish law. The parties submit to the courts of Torremolinos, unless the Sitter is a consumer within the meaning of Article 3 of the TRLGDCU, in which case the court of their domicile will be competent.
The European online dispute-resolution (ODR) platform ceased to operate in 2025, following the repeal of Regulation (EU) 524/2013 by Regulation (EU) 2024/3228. Disputes may be addressed to My Tails at hello@mytails.eu.
